City of Tracy, Front Yard Paving Ordinance - FAQ

What does this ordinance prohibit?
As of September 15, 2017, Section 10.08.3225 of the Tracy Municipal Code (TMC) prohibits property owners from paving more than 50% of their front yard, not including the driveway, unless the paving is comprised of pavers, brick or masonry, and is clearly designed as a landscape feature that does not allow for parking. It is also unlawful for cars to be parked on unpaved surfaces, such as lawns, per Section 10.08.3530 of the Tracy Municipal Code.

What is considered my front yard?
A front yard is the total area extending across the full width of the property, between the front façade of a dwelling and the front lot line, excluding the driveway.

Why did the City of Tracy enact these ordinances?
These ordinances are a part of a broader code enforcement effort to help beautify and enhance the image of the City.

How will the City of Tracy enforce this ordinance?
Enforcement will be on a complaint basis. When a violation is reported to the City’s Code Enforcement Division, a letter will be sent to the registered owner of the vehicle and, if different, the owner and occupant of the property. The letter will give the vehicle and/or property owner ten (10) days to locate an alternative parking space for the illegally parked vehicle.

Where can I park my car?
Vehicles must be parked on a driveway, in a garage, or on the street. It is unlawful to park an inoperable vehicle on an unpaved surface, such as a front lawn.

What if I already paved more than 50% of my front yard?
If the paving was performed prior to the effective date of the ordinance, the paving is deemed “existing non-conforming” and the owner of the site would not have to remove it in order to comply with the current regulations. The current regulations do apply, however, to any increase in the amount of area after August 15, 2017. I have no other place to park my vehicles other than my front yard. This ordinance creates a hardship for me.
The purpose of the ordinance is to improve neighborhoods for all residents and property owners. While it is true that it may be inconvenient for some residents initially, the ultimate goal is a cleaner and more valuable community for everyone. Officials will work diligently with homeowners to minimize hardships, including granting reasonable time periods for achieving voluntary compliance.

What happens if I NOW pave more than 50% of my front yard?
Any person who violates any provision of this article shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of $100 for the first violation, $200 for the second, and $500 for the third violation. In addition to these administrative penalties, judicial penalties may also apply.
