City of Tracy Clarifies Legal Position on Upcoming Election

Tracy, CA – September 19, 2024 – The City of Tracy has been advised that the City Logo was inadvertently included on a flyer related to an upcoming candidate forum.  We have requested, and have been assured that, the logo will be immediately removed from the candidate forum flyer.  The City of Tracy wishes to inform the public that, in accordance with applicable laws and regulations:

  1. California Government Code Section 54964: specifically prohibits local agencies from using public resources to support or oppose candidates in elections.
  2. Federal Election Commission (FEC) Regulations: outlines how federal and state entities must conduct themselves during elections, ensuring fairness and neutrality. we are legally unable to endorse or support any candidate running in upcoming elections.

We are legally unable to endorse or support any candidate running in upcoming elections held on Tuesday, November 5, 2024. This includes the use of city resources and logos.

As a governmental entity, the city is committed to maintaining neutrality in electoral processes. Our focus remains on serving the community. The city encourages all residents to engage in the electoral process by educating themselves about the candidates and participating in voting.

We appreciate the community's understanding and commitment to a fair and impartial election process.
