A local ordinance allowing for the sale of Safe and Sane Fireworks within Tracy city limits was approved by the Tracy City Council in May of 2011. Qualifying 501 (c) nonprofit organizations may participate in fundraising activities through the sale of Safe and Sane Fireworks. Safe and Sane Fireworks are those that bear the official seal of the California State Fire Marshal’s Office . Fireworks that do not bear the official seal of the California State Fire Marshal are considered "dangerous fireworks" and remain illegal within the entire jurisdictional area of the South County Fire Authority.
Safe and Sane Permit Lottery
The maximum number of permits which the City may issue pursuant to Chapter 3.04 for any calendar year shall not exceed one (1) sales permit for each ten thousand (10,000) population or portion thereof. Safe and Sane Fireworks Seller's Permits are available to nonprofit organizations each year. All qualifying organizations are entered into a lottery process and the organizations are randomly selected to continue in the permitting process. Three alternate organizations are also selected in the event a previously selected organization is unable to complete the permitting process.

Safe and Sane Fireworks may only be
sold during the following times:
June 29 - July 3, 8 a.m. – 8:00 p.m.
July 4, 8 AM – 9 PM

Applications shall be submitted during normal business hours from November 1 of each year up to and including the first Thursday of December of the same year, at which time the filing period for that year will close.
2024 Filing Period: 8:00 a.m. on November 1, 2024 through December 5, 2024 at 6:00 p.m.
Nonprofit organizations must complete and submit applications with all required documentation by the filing period deadline to be eligible for the lottery to sell Safe and Sane Fireworks.
The City of Tracy issues permits to sell safe and sane fireworks in the City in accordance with Tracy Municipal Code Chapter 3.04.
On the second Thursday in January of each year at 5:00 p.m., the City Clerk or designee, shall conduct a lottery to fill all available fireworks stand openings for the coming year, from the eligible nonprofit organizations, in the order drawn.
2025 Lottery: 5:00 p.m. on Thursday, January 9, 2025
The lottery will apply only to the upcoming year.
