Notice Inviting Bids
- Bid Acceptance and Opening. The City of Tracy (“City”), will accept sealed bids for its
Interstate 580/Patterson Pass Road/International Parkway Diverging Diamond Interchange Improvements Project, CIP 73147 (“Project”), by or before 2:00 PM April 4, 2024, at the City Clerk’s Office, 2nd Floor, 333 Civic Center Plaza, Tracy, California, 95376. Bids will be publicly opened immediately thereafter.
- Location and Description. The Project is located at I-580 / International Parkway/Patterson Pass Road. Work includes: Constructing a Diverging Diamond Interchange including widening the existing overcrossing using precast concrete girders, overlaying the existing bridge deck, removal and installation of sidewalk, driveway, curb, gutter, and curb ramps; asphalt and aggregate base removal and replacement; temporary and permanent highway lighting and traffic signals, signing and striping.
- Time for Completion. The planned timeframe for work is between June 2024 and June 2026.Contract time to be three hundred (300)working days.
- License. In accordance with the California Public Contract Code 20103.5 when federal funds are involved in local agency contracts, no bid shall be invalidated by the failure of the bidder to be licensed in California at the time of bid opening. However, at the time of award, the selected contractor shall be properly licensed in accordance with the laws of the State and the City of Tracy. Contractor shall possess a valid Class A, General Engineering Contractor license prior to award of Contract or other license qualifying the bidder to bid as a prime Contractor, prior to award of Contract as approved by Council. Said license shall be maintained during the contract period. It is the Bidder’s and Contractor’s responsibility to obtain the correct Contractor’s licenses. Bidders shall be skilled and regularly engage in the general class or type of work called for under this contract.
- DIR Registration. Contractor must submit proof of DIR Registration with Bid Proposal.
- Contract Documents. Bids are required for the entire project work and shall be made upon the Bid Forms in accordance with the Instructions to Bidders.

- Prevailing Wage Requirements. The work is to be done in San Joaquin County. Pursuant to California Labor Code Section 1773, the City has ascertained the General Prevailing Rate of Wages in the County in which the work is to be done to be as determined by the Director of Industrial Relations of the State of California. The Contractor is hereby made aware that information regarding prevailing wage rates may be obtained from the State Department of Industrial Relations and/or the following website address: http://www.dir.ca.gov/dlsr/DPreWageDetermination.htm. The Contractor is required to post a copy of the applicable wage rates at the job site. Attention is directed to Section 7 “Legal Relations and Responsibility” of the Standard Construction Specifications.
The Federal minimum wage rates for this project as predetermined by the United States Secretary of Labor are set forth in the Project Manual and in copies of this book that may be examined at the offices described above where project plans, special provisions, and bid forms may be seen. Addenda to modify the Federal minimum wage rates, if necessary, will be issued
- Bonds. The successful bidder will be required to provide performance and payment bonds, each for 100% of the maximum Contract Price, and a warranty bond for 10% of the maximum Contract Price.
- Substitution of Securities. Substitution of appropriate securities in lieu of retention amounts from progress payments is permitted under Public Contract Code section 22300.
- Subcontractor List. A completed Subcontractor List form must be submitted with the Bid Proposal in accordance with the Instructions to Bidders.
- DBE. The Disadvantaged Business Enterprise (DBE) goal is 22%.
- Non-Discrimination. The City will affirmatively ensure non-discrimination on the basis of one or more of the following: race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, genetic information, marital status, sex, age, sexual orientation, or military and veteran status in the award and administration of contracts that it awards.
- Buy America. Buy America Requirements will be applicable to this project.
- Bid Rigging. The U.S. Department of Transportation (DOT) provides a toll-free “hotline” service to report bid rigging activities. Bid rigging activities can be reported Mondays through Fridays, between 8:00 a.m. and 5:00 p.m., Eastern Time, Telephone No. 1-800-424-9071. Anyone with knowledge of possible bid rigging, bidder collusion, or other fraudulent activities should use the “hotline” to report these activities. The “hotline” is part of the DOT’s continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General. All information will be treated confidentially, and caller anonymity will be respected.
- Pre-Bid Meeting: A Microsoft Teams pre-bid meeting has been scheduled for Monday, March 11, 2024, at 10 a.m. Attendance is recommended but not mandatory; however, it is the contractor’s responsibility to be aware of the existing conditions prior to bidding.
